Terms & Conditions

General Terms and Conditions (T&Cs) for participation in events organised by Conibeta GmbH

Note: Any reference in these terms to the masculine gender also includes the feminine and non-binary genders, and any reference in the singular also includes the plural.

1 Scope of application

(1) Running events are conducted – where a participant holds a start pass from a member club of the DLV (German Athletics Association) – in accordance with DLV regulations (IWR – International Competition Rules and DLO – German Athletics Regulations) and the International Association of Athletics Federations (IAAF), under the supervision of the relevant state athletics association. For participants who are not members of a DLV-affiliated club and do not hold a start pass, events are conducted in accordance with the aforementioned rules. The organiser is Conibeta GmbH, Ringbahnstr. 38, 12099 Berlin.

(2) These terms and conditions govern the legal relationship (organisational contract) between participants and the organiser. They are subject to occasional changes of content. In their version valid at the time of registration, they form part of the contract between the organiser and the participant. Subsequent amendments made in consideration of the legitimate interests of the organiser or participants and published by the organiser online or in writing shall automatically become part of the contract.

(3) All declarations made by a participant to the organiser must be addressed to Conibeta GmbH.

2 Conditions of participation – Safety measures

(1) Anyone who has reached the minimum age specified in the relevant event regulations and is not subject to a start ban is entitled to start. The participant must start in person and must be capable of completing the course under their own steam. Participation using equipment other than that specified in the relevant regulations is not permitted. Animals may not be brought along.

(2) The organiser will communicate organisational measures to participants before the start of the event. Instructions given by the organiser and their clearly identified personnel must be followed without exception. In the event of non-compliance, the organiser is entitled to exclude the person concerned from the event at any time and/or to disqualify them or issue start bans.

3 Registration – Contract conclusion – Payment terms

(1) Registration is possible via online registration on the internet through the "web form" on the respective official event website, or in some cases on the day of the event by submitting a fully completed and legally binding signed registration form.

(2) Each participant may only register once. Duplicate registrations will not be accepted.

(3) The contract is concluded when the participant has accepted the General Terms and Conditions by signing the registration form or by expressly clicking to confirm during online registration.

4 Collection of race materials

Participants will receive their race number at the race pack collection point only upon presentation of the registration confirmation. The race number must be collected in person with a valid photo ID.

5 Withdrawal by the participant – Refunds

If a registered participant fails to start without stating reasons, or notifies the organiser in advance that they will not participate, or is disqualified, there is no entitlement to a refund of the participation fee.

6 Exclusion of liability – Limitation of liability

(1) Participation is at the participant's own risk.

(2) Where the organiser is entitled or required, due to force majeure, official orders or for safety reasons, to make changes to the running of the event or to cancel it, the organiser has no obligation to provide refunds or compensation to participants.

(3) The organiser is not liable for property or financial damage not caused by at least gross negligence; excluded from this limitation of liability are damages to life, body or health of a person.

7 Event information

Current event data can be found on the organiser's official online platforms or other generally accessible sources and the daily press.

8 Data collection and use

The personal data provided by the participant at registration is stored and processed for the purpose of organising and running the event. By registering, the participant consents to the storage, processing and use of their data for these purposes.

9 Timing and conduct contrary to T&Cs, disqualification

If the officially allocated race number is passed on in any way, obtained by false information, or altered, the participant may be excluded from participation. Participants who pass their own race number to other persons for use in the event will be disqualified and may receive a start ban for all Conibeta events for at least 3 subsequent years.

10 Security of electronic payment processing

Conibeta GmbH or a person authorised by Conibeta endeavours to make available procedures corresponding to the current state of technology for the security of electronic registration processing. Nevertheless, Conibeta GmbH accepts no liability for cases of misuse.

11 Miscellaneous

(1) German law applies, even where registration is made from abroad.

(2) Where the registrant has their domicile or habitual residence abroad, Charlottenburg (Berlin) is the exclusive place of jurisdiction for all claims in connection with the registration.

(3) For events taking place in public spaces, the applicable public right of way applies. No right-wing extremist, racist, antisemitic or other anti-democratic ideology may be displayed or disseminated.

(4) The organiser reserves the right pursuant to § 6 of the German Assembly Act (VersG) to exercise its right of domicile. This includes refusing admission to or excluding from the event persons who are members of right-wing extremist parties or other right-wing extremist organisations.

12 Final provisions

Should individual or multiple provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining General Terms and Conditions or the contract as a whole.
